As an operator of a global content dissemination platform, FanHero, LLC (“FanHero”, “Company”, “us”, “we”, or “our”) strives to ensure that only legal, appropriate content appears on our Platform. All Clients and Users (also referred to herein collectively as “you” or “your”) are subject to the terms and conditions of this Content Policy as a result of their required agreement to either the Client Terms and Conditions (“CTAC”) or the End User Licensing Agreement (“EULA”), as the case may be.

This Content Policy applies to all Client Content and End User Content (collectively, “Content”). Capitalized terms used but not defined in this Content Policy have the meaning as set forth in the CTAC or EULA.

Company Discretion

The determination of whether or not Content is in violation of this Content Policy shall be made in the sole discretion of the Company. You acknowledge that the characterization of some Content may be subjective and could vary based on the perspective of the consumer of such Content. We strive to apply generally accepted standards when analyzing Content but cannot guarantee that our interpretation of Content will agree with your interpretation. In addition, you acknowledge that the application by us of these policies may vary, in our sole discretion, between differing geographies or audiences. For instance, the community standards applicable in the Middle East may vary from those applicable in the North America.

Remedy

The remedies available to us in the event that we determine your Content to be in violation of this Content Policy are as set forth the CTAC or EULA, as applicable to you. These remedies include, but are not limited to, removal of any offending Content, or the removal of a Channel or an Application, or complete Agreement termination.

Third-Party Content Policies

In addition to this Content Policy, you acknowledge that the various third-parties that comprise the Distribution Network can and do maintain their own content policies to which your Content is also subject. We will honor requests or demands made on us to remove or restrict Content that is in violation of such third-party content policies.

Policy

You may not post or retain, anywhere on the Platform:

Illegal

Content that is Illegal under the laws of the United States or under the laws, rules or regulations applicable to either you or the User;

No Right to Use

Content that is in violation of any applicable copyright laws or for which you do not possess the necessary legal right to use or post;

Illegal in Application

Content that promotes, supports or advocates for any activity that is illegal under the laws of the United States or under any laws, rules or regulations applicable to you or the User;

Pornographic

Content that is primarily pornographic in nature;

Violence or Harassment

Content that is intended to promote or advocate violence or harassment against a) another person, group or identifiable subset of people; or b) the assets, property or possessions of another person, group or identifiable subset of people;

Misleading or Deceptive

Content that, in our sole discretion, is deliberately intended to mislead or deceive Users, especially with the goal of achieving an illegal or immoral outcome;

In Violation of Community Standards

Content that is in violation of community standards as determined in the discretion of FanHero;

Affiliation with Groups We Deem to Violate Our Policies

Content that is affiliated or generally aligned with groups that we determine, based on their nature, policies or stated agenda, are in violation of these policies;

Non-Consensual

Content that is about or involves a third person who a) has not granted consent to such dissemination, and b) we become aware, or have reason to believe, objects to such dissemination; or

Endangers Children

Content that we believe, in our sole discretion, endangers the safety and security of children or is designed to exploit children.

Cooperation with Law Enforcement

We will cooperate with duly authorized legal actions that are specific in nature and issued by law enforcement agencies of competent jurisdiction. Such cooperation may include enabling access to your Content that is either active or cached in our databases and therefore still accessible by us.
